I am 18 or olderWe advise you to read the present general conditions of sale which determine the contractual relations between the Cave of Bonnieux, District of the Station, 84480 Bonnieux (here after “Us”) and any person making a purchase (here after “You”) by through our online store on the site “www.cave-bonnieux.com” (hereinafter “the Site”).
Any order sent to the Cave de Bonnieux implies the acceptance of these conditions of sale.
You declare to be at least 18 years old and have the legal capacity or to hold a parental authorization allowing you to make an order on the Site. Any order placed on the Site must correspond to the normal needs of a household. We reserve the right to cancel an order that appears to be fraudulent.Our minimum order is 6 bottles (1 carton) and / or 5L for Bag-in-Box®. You can mix your boxes. Any order will be accepted only after confirmation from us by e-mail. The contract will be formed. We reserve the right to refuse an order.
The selling prices of the products are those in force at the time of the registration of the order and are in Euros all taxes included (T.T.C.), excluding transport costs. We reserve the right to change prices during the year but we guarantee the rates charged when placing your order. Shipping costs are your responsibility and are charged in addition to the amount of the order. They will be indicated at the registration of your order.
Payments are made at the order in several ways: – by check payable to the Cave de Bonnieux. In this case an additional period of 15 days minimum is expected – by credit card (visa, mastercard, american expess) in secure payment. You authorize your bank to debit your account at the sight of the records or statements transmitted by us, even in the absence of signed invoices from the cardholder’s hand. Account debit authorization is given for the total amount of the product purchased, including any customs fees and transportation. An invoice will be sent to you at the time of collection and shipping. We reserve the right to cancel any order from a buyer with whom We have had a dispute over the payment of a previous order.
Our products are only delivered in Metropolitan France and Germany to the address indicated on the order form. It is your responsibility to provide us with exactly all the details necessary for the proper delivery of your order. Delivery will only be made after receipt of payment of the invoice. We, through our delivery provider, undertake to respect the deadlines that the latter has given us by signing a commercial agreement. However, we will not be held responsible for delivery delays caused by the carrier or any other incidental event. The kidnappings will be carried out from Monday to Friday. Delivery times are 72 hours minimum. We are committed to communicate on each product the cases of out of stock and to notify you by e-mail. We reserve the right to send you an equivalent proposal in case of stock depletion. If it is refused the sale will be canceled. We use the carriers that we have selected according to our specifications and which are bound by a contractual act. When receiving the product, it is your responsibility to check the conformity and condition of the products shipped. You must record on the delivery note, after verification of the integrity of the delivered products, any deterioration or error of control found. In the absence of such notification, you will be presumed to have waived any legal action on this basis against the Cave de Bonnieux. In case of problem, please contact our customer service. In case of late delivery exceeding 7 days and not due to a case of force majeure, You may terminate the contract by email or accept a new delivery period, without being able to demand a discount.
In accordance with Article L. 121-16 of the Consumer Code, you have a period of 7 days from the date of issue of the delivery note to return the purchased product at Your expense, without having to justify of reasons. After this period, the right of return no longer applies. The product must be returned in its original packaging, in perfect condition, without external marking and accompanied by a copy of the delivery note. If the return is due to an error on our part, the return costs will be at our expense. In this case You must attach to the parcel a proof of the costs of re-shipping so that we can refund you. You authorize in advance that the returned product is subject to a thorough inspection by us before the exchange or refund of it. Sealed products must be sealed again in order to be returned. The refund will be made within 30 days of receipt of the product by the Cave de Bonnieux.
In accordance with the law of May 12, 1980 (n ° 80-335) the Cave de Bonnieux expressly reserves the property of the delivered products until the full payment (collection “under good end”) of the price and the expenses and accessories. You agree not to resell, pledge or assign as security, the product sold until the sums due to us have been paid in full. The payment is defined as the actual receipt of the total price of the product sold (wine + transport + incidental expenses) on our account. Otherwise, the products will be claimed by Us.
Our products comply with the legislation in force in our country. In case of manufacturing defect of the product sold, you have the legal guarantee of hidden defects of articles 1641 and following of the French Civil Code.
Your details are only used to process your order. They will in no case be communicated to third parties. You benefit from the possibility to rectify the information concerning you. Unless you refuse, we may send you personalized messages during our promotional activities.
Notwithstanding articles 1341 and following of the Civil Code, the computer records that we keep constitute proof of the contractual obligations of the parties. You can report the contrary evidence of Our allegations. This mode of proof is also admissible for sums inferior or superior to 800 Euros.
All complaints must be sent by mail to the Cave de Bonnieux or by e-mail to customer service. It will then be examined and processed as soon as possible. In case of difficulties in the application of this contract, the parties must seek an amicable solution before triggering any legal action. In the event of failure of the amicable settlement, the dispute concerning the interpretation or the execution of the contract will be the competence of the High Court of AVIGNON (84) in FRANCE.
We reserve the right to adapt or modify at any time these Terms and Conditions of Sale which will be immediately brought to the attention of the buyer by an update online. Contracts awarded are subject to the General Conditions of Sale in force at the time of the order.
